Although Chapter 42 no longer ends on Monday, the border patrol is still “all in hand” as they prepare for the influx of migrants in the next few weeks.

Migrants from Columbia, Honduras, Guatemala, Cuba and Nicaragua continued to seep across the southern border across the Rio Grande River to Eagle Pass, Texas, on Sunday afternoon. However, the number of people crossing the border is much smaller than in recent months at this particular checkpoint.

A Texas National Guard soldier told DailyMail.com on Sunday in the Eagle Pass that those patrolling the border are still expecting an influx this week, even if the 42nd title remains in effect.

He said he was not sure migrants even knew the policy would no longer be repealed.

Some believe the less congested crossing than usual was due to Mexican police patrolling the Piedras Negras area on the Mexican side of the Rio Grande on Sunday – and argue that this had little to do with policy change. in section 42.

Others argue that migrants from Central America, who have been waiting in Mexico for months, have decided to cross them on Monday and do not change their plans, even if US policy is no longer changing.

Chapter 42 was due to end on Monday, May 23, 2022, but a federal judge in Louisiana on Friday issued a ban that prevents the government from stopping policy.

The policy of the pandemic era was adopted in March 2020 under then-President Donald Trump as a way to suppress mass migration on the southern border at the start of the coronavirus crisis. Section 42 is overseen by the Centers for Disease Control and Prevention (CDC) and allows migrants to be expelled instantly without officials hearing asylum applications during a health emergency.

All the powers of the Border Guard Service to combat illegal immigration fall under Section 8, not Section 42.

Title 42 has stopped 1.7 million illegal immigrants since the start of the pandemic. Humans Rights First found that of those deported back to Mexico under the law, 10,200 of them – or 0.006 percent – were abducted, raped, tortured or assaulted.

When the CDC announced last month’s renunciation of the 42nd title more than two years later, it immediately met with reaction from Republicans, national security hawks and even some Democrats, who argued it would leave the border wide open to illegal immigration.

Many have also argued that it makes no sense to repeal Title 42 while the U.S. is still in an active state of emergency because of COVID-19.

Both Democrats and Republicans support legislation that will retain Chapter 42 until all pandemic-era restrictions in the United States, Canada, and Mexico are lifted – and until an emergency order is lifted in the United States.

Judge Robert Summerhays of West Louisiana County ruled on Friday a temporary stay to lift Biden’s restrictions in Section 42 after the lawsuit was filed and signed by two dozen Republican-led states.

Judge Summerhays, appointed by Trump, has issued a preliminary injunction against the Biden administration’s decision to lift the restriction in response to a lawsuit filed by Arizona, Louisiana and Missouri.

The lawsuit alleges that the CDC violates the Administrative Procedures Act because they did not provide a notice and comment period for the repeal plan of Section 42. The law in question also prohibits actions that are considered “arbitrary and capricious”.

The plaintiffs also claim that the Biden administration did not take into account the additional costs for the states – especially the border states – due to the fact that more migrants are allowed into the United States

Several couples, individuals and families crossed the Rio Grande River under the Eagle Pass International Bridge on Sunday afternoon.

Domestic forecasts have predicted that after Chapter 42 is over, migration will triple, and according to other estimates, it could increase from the current 8,000 transitions per day to 18,000.

Although Chapter 42 no longer ends on Monday, as previously thought, border service agents and the National Guard, which are helping patrol the border, are still waiting for pressure crossings for next week.
