SAN ANTONIA – Two parents from San Antonio sued Apple after their 14-year-old son allegedly had his right eardrum torn by a pair of Apple AirPods.
Carlos Gadoa and Ariani Reyes filed a lawsuit in California federal court earlier this week, records show.
According to the lawsuit, their son was watching Netflix on his iPhone with AirPods “at low volume” on May 17, 2020, when suddenly the Amber Alert alert went off at high volume.
A sudden noise “tore” the boy’s eardrum and caused significant damage and permanent hearing loss to his right ear. Also, according to the court, he had dizziness, vertigo and nausea.
According to the lawsuit, several customers had previously filed a complaint about the defect on AirPods, which caused a sudden and unexpected increase in volume.
Parents claim that Apple was negligent and did not properly respond to complaints about headphone volume.

Parents are seeking a jury trial and are seeking to hold Apple financially liable for “as a result of the severe emotional stress” experienced by the incident.
Court records show that Apple has not yet filed a response to the lawsuit.
